Persona non grata (Pilipinas)
Ang persona non grata, sa konteksto ng paggamit ng salita ng pamamahala sa Pilipinas, ay tumutukoy sa mga indibidwal o grupong idineklara bilang hindi tanggap sa isang partikular na lokalidad. Ang pagtatalagang ito ay simboliko lamang at walang bisa, at hindi legal na nagbabawal sa isang taong idineklara bilang persona non grata na tumuntong sa lokalidad na iyon.
Kahulugan
[baguhin | baguhin ang wikitext]Ang persona non grata sa Latin ay nangangahulugang hindi tanggap na tao o unwelcome person. Sa konteksto ng diplomasya o internasyonal na relasyon, ang isang deklarasyon ng persona non grata sa isang dayuhang mamamayan ay karaniwan sa isang diplomat na kung hindi man ay may pribilehiyo ng immunity, ay pinagbabawalan na makapasok sa bansang naglabas ng deklarasyon. [1] Sa konteksto ng lokal na pamamahala sa Pilipinas, maaaring magdeklara ng persona non grata ang mga local government units (LGUs, kabilang ang mga munisipalidad, lungsod, at lalawigan). Ang isang dahilan para sa pagdedeklara nito ay bilang tugon sa partikular na taong lumalabag sa mga lokal na ordinansa at batas. [2]
Ang deklarasyon ay magpapahiwatig na ang isang tao ay pinagbabawalan na pumasok sa hurisdiksyon ng isang partikular na lokalidad. [2] Gayunpaman, ayon sa legal na opinyon ng Kagawaran ng Interyor at Pamahalaang Lokal (DILG), ang mga deklarasyon ng persona non grata ay kadalasang ginagawa sa pamamagitan ng mga resolusyon ng lokal na lehislatura sa halip na mga ordinansa at ginagawa lamang upang magpahayag ng damdamin; na epektibong nangangahulugan na ang mga naturang deklarasyon ay walang bisa. Sa kaso ng municipal council ng Anahawan, Southern Leyte sa pagdedeklara ng persona non grata sa bagong-luklok na Mayor na si Roberto Loquinte dahil sa opinyon nila na si Loquinte ay hindi nararapat sa posisyon, sinabi ng DILG na ang lokal na lehislatura ay nasa kanilang karapatan na maglabas ng deklarasyon ngunit ang katulad nito ay dapat gawin "sa loob ng mga hangganan ng batas". Sinabi dito na hindi nito legal na mapipigilan si Loquinte mula sa pag-ako sa posisyon bilang Alkalde at/o sa pagtupad sa kanyang tungkulin, isang akto na sa tingin ng DILG ay hindi masisisi.[3] [4]
Kilalang personae non gratae

Hindi kasama dito ang mga dayuhan na tinanggalan lamang ng kakayahan na pumasok at/o pinatapon ng pambansang pamahalaan ng Pilipinas kundi ang mga dayuhan na idineklarang persona no grata ng mga LGU.
